Article 4 Rent, Security Deposit and Payment Method

 

1.租金标准:前5年为固定租金,租金为人民币;第6年至第10年为可变租金,按照市场行情由双方协商一致决定。如协商不成,双方都拥有单方解除本租赁合同的权利,同时《股权代持协议》随即终止,应按双方约定进行移交。

(3)乙方按期将租金汇入甲歹指定银行账户。甲方账户信息如下:

协议期内如甲方变更收款帐号,应及时告知乙方,如未及时告知,乙方仍付至上述账户,视为乙方已履行支付租金义务。

If Party A changes its account during the term of this Agreement, it shall notify Party B in time. Otherwise, if Party B still makes payment to the above account, then it shall be deemed to have fulfilled the obligation to pay the rent.

 

3、 在乙方支付租金前,甲方应到税务局代开发票。

3.Party A shall go to the tax bureau to apply for the issuance of an invoice on its behalf before Party B pays the rent.

 

4、 押金标准:5万元。租赁期满或合同解除后,押金除抵扣应由乙方承担 的费用、租金、赔偿甲方损失外,剩余部分应无息返还乙方。

4.Security Deposit: RMB 50,000. Upon the expiration of this Lease or the termination of this Agreement, the remainder of the Security Deposit shall be returned to Party B free of interest after the expense, rent and compensation for Party A’s losses to be borne by Party B are deducted.

 

5、 租赁期间,押金因甲方有权扣除损失赔偿、租金和费用等不足5万元,乙方在3日内补足5万元,逾期不补足,甲方有权解除本合同。

During the term of this Lease, where the Security Deposit is less than RMB 50,000 due to Party A’s deduction of loss compensation, rent and expense, Party B shall make up the shortfall in the Security Deposit until it reaches RMB 50,000 within 3 days., failing which Party A shall have the right to terminate this Agreement.

 

示例二:

1.RENTAL AMOUNT: Commencing __________, 2020, TENANT agrees to pay LANDLORD the sum of $____per month in advance on the ___ day of each calendar month. Said rental payment shall be delivered by TENANT to LANDORD or his designated agent to the following location:

租金:自___年____月____日开始,租客同意在每月第___日提前向业主支付该月租金____元;该租金付款将由租客在下列地址交给业主或其指定的代理人:

 

Rent must be actually received by LANDLORD, or designated agent, in order to be considered in compliance with the terms of this agreement.

2.Security Deposits: TENANT shall deposit with landlord the sum of $____as a security deposit to secure TENANT’S faithful performance of the terms of this lease. The security deposit shall not exceed two times the monthly rent. After all the TENANTS have vacated, leaving the premises vacant, the LANDLORD may use the security deposit for the cleaning of the premises, and any rent or other amounts owed pursuant to the lease agreement or pursuant to Civil Code Section 1950.2.

保证金:租客须向业主提交$____保证金,作为租客将忠实履行租约条款的保证。保证金不得超过月租金的两倍。在所有租客搬离、腾出住所后,业主可用保证金款项来清洁住所,维修因租客过度使用住所或住所之公共场地所造成的超出一般磨损的损毁,以及支付根据租约或民事法典1950.5条所欠付的任何租金或其他金额。

 

TENANT may not use said deposit for rent owed during the term of the lease. Within 21 days of the TENANT vacating the premises, LANDLORD shall furnish TENANT a written statement indicating any amounts deducted from the security deposit and returning the balance to the TENANT. If TENANT fails to furnish a forwarding address to LANDLORD, then LANDLORD shall send said statement and any security deposit refund to the leased premises.

租客不得用保证金支付租期内欠付的租金。在租客腾出住所21日内,业主须以书面结算单形式告知租客从其保证金中扣除的金额,并将保证金的余额退还租客。如果租客未能向业主提供其新地址,业主须将书面结算单及保证金退款寄往以上住处的地址。

 

INITIAL PAYMENT: TENANT shall pay the first month rent of $______and the security deposit in the amount of $_____for a total of $_____. Said payment shall be made in the form of cash or cashier’s check and is all due prior to occupancy.

首期付款:租客须支付首月租金$_____。该两项付款须以现金或本票形式、在入住之前支付。

3.1 The agreed rental amount is :________per month. The rental fee includes the official tax invoice.

经过协商后的租金为:人民币______。此租金内包括租金发票税。

 

3.2 The property management fee is included in the monthly rental payment.

物业管理费已包含于每月所付租金。

 

3.3 The security deposit and first month’s rent defined in Article 2.2 shall be paid on the Delivery Date and prior to occupation of the Premise and before Party B may start renovation.

保证金和首月租金须于签订本合同当天和入住租赁物业之前及乙方可能开始装修之前支付。

 

3.4 Party B shall pay the rent on or before the 25th day of every calendar month in advance of the month requiring payment. The rent shall be made by bank transfer to a bank account designated by Party A below and the date that Party B transfers payment shall be considered the “date of payment”. Party A shall provide an official invoice within three (3) days from the date of payment

每月租金和物业管理费应于租赁该物业之前于前一25日或之前支付。乙方应按照补充条款付款。月付款要通过银行转账的方式支付到甲方指定的下列账户。甲方收到款项之日视为支付日。甲方应当在收到款项的3日内提供正规发票。
