民间文学艺术作品（works of folklore/expressions of folklore/Folk literature art work/folklore），对于此类作品，在不同国家有不同内容，不同国家为民间文学艺术作品提供保护的出发点也不完全相同。

在我国，2021年6月1日生效的《中华人民共和国著作权法》第三条

本法所称的作品，是指文学、艺术和科学领域内具有独创性并能以一定形式表现的智力成果，包括：

（一）文字作品；

（二）口述作品；

（三）音乐、戏剧、曲艺、舞蹈、杂技艺术作品；

（四）美术、建筑作品；

（五）摄影作品；

（六）电影作品和以类似摄制电影的方法创作的作品；

（七）工程设计图、产品设计图、地图、示意图等图形作品和模型作品；

（八）计算机软件；

（九）法律、行政法规规定的其他作品。

民间文学艺术作品的特征：

（1）民间文学艺术作品是一种通过某个社会群体几代人的不断模仿而进行的非个人的、连续的、缓慢的创作活动过程的产物。

（2）民间文学艺术作品的表现形式丰富。

（3）民间文学艺术作品的作者是创作该民间文学艺术作品的社会群体。

（4）民间文学艺术作品的权利属于创作、保存该民间文学艺术作品的社会群体。

（5）民间文学艺术作品权利的保护，不受时效的限制。

（6）在传统和习惯范围内使用民间文学艺术作品都属于合理使用

（7）民间文学艺术作品的权利由创作、保存该作品的社会群体行使，或者民间文学艺术作品的财产权利由当地民间文学艺术的主管部门行使。

（8）民间文学艺术作品的财产权利不能转让，但允许授权使用。

In this note, WIPO would like to draw attention to: (a) recent developments in the negotiations being undertaken by its Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore; (b) mechanisms to facilitate the participation and contribution of indigenous peoples and local communities in the work of the Intergovernmental Committee; and (c) capacity-building and awareness-raising initiatives that have been undertaken by WIPO in 2011.
