自首（voluntarily surrender oneself），是指犯罪以后自动投案，如实供述自己的罪行的行为。被采取强制措施的犯罪嫌疑人、被告人和正在服刑的罪犯，如实供述司法机关还未掌握的本人其他罪行的，以自首论。据此，自首可以分为一般自首与准自首。

坦白，是指犯罪分子被动归案之后，自己如实交代所被指控的犯罪事实，并接受国家审查和裁判的行为。

自首与坦白与存在着明显的区别：

(一)自首是犯罪人自动投案之后，主动如实交代自己犯罪事实的行为；坦白是犯罪人被动归案之后，如实交代自己所被指控的犯罪事实的行为。

(二)自首与坦白所反映的犯罪人的人身危险性程度不同，自首犯的人身危险性相对较轻重。

(三)自首是法定的从宽处罚情节，坦白只是酌定的从宽处罚情节。

《刑法》第六十七条

【自首】犯罪以后自动投案，如实供述自己的罪行的，是自首。对于自首的犯罪分子，可以从轻或者减轻处罚。其中，犯罪较轻的，可以免除处罚。

被采取强制措施的犯罪嫌疑人、被告人和正在服刑的罪犯，如实供述司法机关还未掌握的本人其他罪行的，以自首论。

犯罪嫌疑人虽不具有前两款规定的自首情节，但是如实供述自己罪行的，可以从轻处罚；因其如实供述自己罪行，避免特别严重后果发生的，可以减轻处罚。
